Welcome to Quantum Recreation. These Terms and Conditions ("Terms") govern your use of our website and services. By accessing our website or engaging our consulting services, you agree to be bound by these Terms.

ABOUT QUANTUM RECREATION
Quantum Recreation is a professional recreation and parks consulting firm established in 2012, specializing in playground inspection and safety compliance, recreation and park master planning, municipal recreation services, park and sports field safety inspections, drone field surveys, feasibility studies, and recreation infrastructure planning. We serve clients across Alberta, British Columbia, Ontario, Atlantic Canada, and Massachusetts, maintaining affiliations with ARPA, NRPA, BCRPA, AARFP, RFPBC, PRO, and the Ontario Parks Association while adhering to CSA Z614 standards, Project Management International guidelines, and International Association of Public Participation protocols. 

SERVICES AND SCOPE
Our consulting services encompass playground inspection and safety assessments ensuring CSA Z614compliance, comprehensive recreation and park master planning, municipal recreation service consulting, park and sports field safety inspections utilizing specialized equipment including drones, inspection toolkits, and Triax devices for Gmax and HIC testing, drone field surveys for asset assessment, feasibility studies for recreation infrastructure development, and recreation infrastructure planning incorporating proprietary lifecycle models. Service fees typically range from $10,000 to $75,000 for planning projects,$385 to $1,500 per site for playground inspections, $550 to $1,500 for field testing, and $550 to $1,500 persite for drone assessments, with project timelines spanning 1 to 14 days for playground inspections and 3to 24 months for comprehensive planning projects.

PROFESSIONAL STANDARDS AND LIABILITY
Quantum Recreation maintains comprehensive professional liability insurance and adheres to industry best practices in all consulting engagements. Our services are provided by qualified professionals with appropriate certifications and expertise in recreation planning, playground safety inspection, and related fields. While we strive for accuracy and completeness in all deliverables, our liability is limited to the value of services provided for any specific project. Clients are responsible for implementing recommendations in accordance with applicable local, provincial, and federal regulations and standards.

INTELLECTUAL PROPERTY
All reports, assessments, plans, and other deliverables created by Quantum Recreation remain our intellectual property until full payment is received, at which point clients receive a license to use them aterials for their intended purpose. Clients may not reproduce, distribute, or modify our proprietary methodologies, lifecycle models, or assessment tools without express written permission. Our inspection portal and related technologies remain the exclusive property of Quantum Recreation.

PAYMENT TERMS AND CONDITIONS
Payment terms are net 30days from invoice date unless otherwise specified in individual consulting agreements. Late payments may incur interest charges at a rate of 1.5% per month or the maximum rate permitted by law, whichever is lower. Quantum Recreation reserves the right to suspend services for accounts more than 60 days past due and to engage collection agencies or pursue legal remedies for severely delinquent accounts.

CONFIDENTIALITY AND NON-DISCLOSURE
Quantum Recreation maintains strict confidentiality regarding all client information, project details, and proprietary data encountered during the course of our consulting engagements. We will not disclose client information to third parties without express written consent, except as required by law or professional standards. Clients similarly agree to maintain confidentiality regarding our proprietary methodologies ,assessment techniques, and business practices.

LIMITATION OF LIABILITY
Quantum Recreation's total liability for any claims arising from our services shall note xceed the total fees paid for the specific project giving rise to the claim. We shall not be liable for consequential, indirect, incidental, or punitive damages, including but not limited to lost profits, business interruption, or costs of substitute services. This limitation applies regardless of the theory of liability, whether in contract, tort, or otherwise.

INDEMNIFICATION
Clients agree to indemnify and hold harmless Quantum Recreation, its principals, employees, and subcontractors from any claims, damages, or expenses arising from the client's use or misuse of our services ,failure to implement recommendations properly, or violation of applicable laws and regulations in connection with their recreation facilities or programs.

FORCE MAJEURE
Neither party shall be liable for delays or failures in performance resulting from circumstances beyond their reasonable control, including but not limited to acts of God, natural disasters, government actions, labor disputes, or other unforeseeable events. In such cases, performance obligations shall be suspended for the duration of the force majeure event.

DISPUTE RESOLUTION
Any disputes arising from these Terms or our consulting services shall be resolved through binding arbitration in accordance with the rules of the applicable provincial or state arbitration association. The arbitration shall be conducted in the jurisdiction where Quantum Recreation's principal office is located, and the prevailing party shall be entitled to recover reasonable attorney fees and costs

MODIFICATIONS AND AMENDMENTS
Quantum Recreation reserves the right to modify these Terms at any time by posting updated terms on our website. Continued use of our services following such modifications constitutes acceptance of the revised Terms. Material changes to existing consulting agreements require written consent from both parties.

SEVERABILITY AND GOVERNING LAW
If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions shall continue in full force and effect. These Terms shall be governed by the laws of the jurisdiction in which services are primarily performed, without regard to conflict of law principles
